Terms of Service — Khulumani

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Khulumani, including the web application at app.khulumani.com, the Khulumani LinkedIn Connector browser extension, and related services (collectively, the "Service").

By creating an account, installing the Extension, or otherwise using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

Khulumani is a relationship intelligence and engagement platform designed to help professionals build, manage, and strengthen meaningful business relationships

Features may include:

  • Importing and organizing professional contacts

  • Importing LinkedIn connections using the Khulumani LinkedIn Connector

  • AI-assisted relationship insights and recommendations

  • Goal and engagement tracking

  • Drafting outreach messages for LinkedIn, email, SMS, and other supported channels

  • CRM integrations

  • Relationship analytics and networking tools

Features may change over time as the Service evolves.

3. Eligibility and Accounts

To use the Service, you must:

  • be at least 18 years old;

  • provide accurate and complete registration information;

  • maintain the security of your account credentials; and

  • promptly notify us of any unauthorized use of your account.

Accounts are personal to the registered user and may not be shared, transferred, or sold.

4. Subscription & Billing

Paid subscriptions are billed monthly or annually in advance. If you begin a free trial, your subscription may automatically convert to a paid subscription unless canceled before the trial period ends. Unless otherwise required by law:

  • subscription fees are non-refundable;

  • cancellations take effect at the end of the current billing period; and

  • applicable taxes are your responsibility.

We may change subscription pricing by providing at least thirty (30) days' advance notice.

5. Acceptable Use

You agree to use the Service responsibly and in compliance with applicable laws and third-party agreements.

You may not

  • violate the terms of service of LinkedIn or any integrated platform;

  • use the Service to send spam or unsolicited communications;

  • process personal information without an appropriate legal basis where required by law;

  • attempt unauthorized access to the Service or its infrastructure;

  • interfere with the security or operation of the Service;

  • reverse engineer, decompile, or attempt to extract source code except where permitted by law; or

  • resell, sublicense, or commercially redistribute the Service without our written permission.

6. Browser Extension

  • The Khulumani LinkedIn Connector is an optional component of the Service.

  • The Extension performs only the actions you initiate, including importing LinkedIn connections and preparing LinkedIn messages for you to review and send manually.

  • The Extension does not send messages automatically and does not access LinkedIn beyond the workflows you request.

  • Your use of the Extension is also governed by the Khulumani Privacy Policy.

7. Third-Party Services

  • Khulumani integrates with third-party platforms and services, which may include LinkedIn, AWS, AI providers, CRM platforms, and other technology partners.

  • Your use of those services remains subject to their own terms, privacy policies, and acceptable use requirements.

  • We are not responsible for the availability, functionality, or policy changes of third-party services.

8. Data & Privacy

  • Our collection and use of information is governed by the Khulumani Privacy Policy.

  • You retain ownership of the contacts, information, and content you upload or import into your account.

  • We process your information solely to provide and improve the Service.

  • We do not sell your imported contact information to third parties.

  • If your account is deleted, account data will generally be retained for up to thirty (30) days before permanent deletion, unless a longer retention period is required by law.

9. AI-Generated Content

  • Khulumani may use artificial intelligence to generate summaries, recommendations, message drafts, relationship insights, and other suggested content.

  • AI-generated content is provided to assist you and should be reviewed before being relied upon or shared.

  • You remain responsible for all communications you send and decisions you make using the Service.

  • Khulumani does not provide legal, financial, employment, medical, or other professional advice.

10. Intellectual Property

  • The Service, including its software, branding, logos, documentation, and related materials, is owned by or licensed to Khulumani and is protected by applicable intellectual property laws.

  • Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Service during your active subscription.

  • Nothing in these Terms transfers ownership of the Service or its intellectual property to you.

11. Disclaimers

  • The Service is provided on an "as is" and "as available" basis.

  • To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • We do not guarantee uninterrupted availability, error-free operation, or the accuracy of AI-generated content.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service shall not exceed the greater of:

  • the fees you paid during the three (3) months immediately preceding the claim; or

  • USD $100.

We shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Khulumani, its owners, employees, contractors, and affiliates from claims arising from:

  • your misuse of the Service;

  • your violation of these Terms;

  • your violation of applicable law; or

  • your infringement of the rights of another person or organization.

14. Suspension and Termination

You may cancel your subscription at any time through your account settings. We may suspend or terminate access to the Service if you violate these Terms or use the Service in a manner that creates legal, security, or operational risk.

15. Changes to These Terms

  • We may update these Terms from time to time.

  • If we make material changes, we will provide reasonable notice through the Service, by email, or by other appropriate means.

  • Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws applicable to the legal entity operating Khulumani, without regard to conflict-of-law principles.

Any disputes shall be resolved in the courts having jurisdiction over that legal entity unless otherwise required by applicable law.
